1. Services & Availability

All services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that our services will be uninterrupted, error-free, secure, or available at any particular time.
We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

2. Payments & Refunds

Services are activated after we receive your full payment.
You may request a full refund within 48 hours of your initial purchase. To request a refund, contact us at [email protected] within this 48-hour window. Refunds apply to the first purchase of a service only and do not apply to renewals, upgrades, or add-ons.
After 48 hours have passed, all payments are final and non-refundable. No refunds, credits, or exchanges will be issued after this period under any circumstances, including but not limited to service dissatisfaction, account suspension, or termination.
No refund will be issued, even within the 48-hour window, if your account or service is suspended or terminated for a violation of these terms, or where we determine the refund request is abusive (for example, repeated purchase-and-refund cycles). Cryptocurrency payments are non-refundable.
We may limit or suspend free or paid services if they are abused or violate these terms.

3. Account Suspension & Termination

We reserve the right to suspend or terminate any account at our sole discretion, with or without cause, and with or without prior notice.
Upon suspension or termination of your account, all data associated with your account may be permanently deleted. We are under no obligation to retain, recover, or provide any data after suspension or termination.
You acknowledge that once an account is suspended or terminated, data recovery is not possible and Orihost bears no responsibility for any lost data, files, configurations, or content.
Creating or using alternate accounts (alt accounts) is strictly prohibited and may result in the suspension or termination of all associated accounts and servers.

4. Server Suspension & Data Deletion

Suspended servers are subject to automatic cleanup and permanent data deletion daily at 20:00 CET.
Once a server has been suspended, all files, databases, configurations, and associated data on that server may be irreversibly deleted during the next scheduled cleanup.
We are not responsible for recovering, restoring, or providing any data from suspended or deleted servers.
It is your sole responsibility to maintain backups of all your data. We strongly recommend maintaining independent, off-platform backups at all times.

5. Data Loss & Backups

Orihost is not responsible for any data loss, corruption, or damage, whether caused by hardware failure, software errors, security breaches, scheduled maintenance, service outages, account suspension, server migration, or any other reason.
You are solely responsible for maintaining your own backups. We do not guarantee that backups will be available, complete, or recoverable.
Any backup services we may offer are provided as a convenience only and are not guaranteed to function correctly or completely.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Orihost, its owners, operators, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, files, or configurations
• Loss of revenue, profits, or business opportunities
• Service interruptions or downtime
• Unauthorized access to or alteration of your data
• Any damages resulting from third-party actions, attacks, or exploits
• Any damages resulting from account suspension or termination

In no event shall our total liability exceed the amount you have paid to Orihost in the twelve (12) months preceding the claim.
This limitation applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, or any other theory.

7. Indemnification

You agree to indemnify, defend, and hold harmless Orihost, its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

8. Account Security

You are solely responsible for maintaining the security of your account, including your password and any API keys or access tokens.
We are not liable for any unauthorized access, data breaches, or damages caused by your failure to secure your account.

9. Acceptable Use

You agree not to use our services in any way that disrupts, damages, or negatively impacts our network, infrastructure, or other users.
Accounts or servers that violate these rules or pose a threat may be suspended or terminated permanently without prior notice.

10. Content Rules

No illegal, infringing, obscene, defamatory, or harmful material is allowed on our platform.
We reserve the right to remove any content at our sole discretion without notice.
You are solely responsible for all content hosted on or transmitted through your account.

11. Fair Use Policy

Fair Use Notice: All plans include fair use. Please keep your usage reasonable and don't impact the service for others.

11.1 Prohibited Activities

• Resource Abuse: No excessive bandwidth, server overloads, or anything that disrupts our network.
• Unauthorized Bots & Tools: No spam bots, selfbots, crypto-mining, VPN/proxy services, or anything that overloads the server or network, especially on our free host.
• Game Bots on Free Tier: Free Fire Bots and Minecraft Bots are not allowed on the free tier.
• Obfuscated Code: Uploading or running obfuscated, encrypted, or otherwise intentionally unreadable code on the free tier is not allowed.
• Illegal Activity: Any use of our services for illegal purposes is strictly prohibited.

11.2 Security

• No Unauthorized Access: No hacking, malware, exploits, or unauthorized access attempts. Report vulnerabilities responsibly.

11.3 Enforcement

• Monitoring: We may monitor usage to ensure compliance and maintain service quality. We reserve the right to manually access and review server files, databases, and configurations for compliance, security, and abuse prevention purposes. All manual reviews are conducted exclusively by the management team and any information accessed is kept strictly confidential.
• Automated Detection: We use automated systems to detect abuse (crypto mining, selfbots, proxies). Accounts and servers may be suspended without notice if flagged.
• Violations: We may remove content, suspend, or permanently terminate accounts for any violation of these terms.

12. Dispute Resolution

Any disputes arising from these terms or your use of our services shall be resolved through informal negotiation first. If a resolution cannot be reached, both parties agree to resolve disputes through binding arbitration rather than in court, to the extent permitted by applicable law.
You agree to waive your right to participate in class action lawsuits or class-wide arbitration against Orihost.

13. Force Majeure

Orihost shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, power outages, internet disruptions, cyberattacks, government actions, or pandemics.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Changes to These Terms

We reserve the right to update or modify these terms at any time without prior notice. Changes take effect immediately upon posting. Your continued use of our services after any changes constitutes acceptance of the updated terms.
It is your responsibility to review these terms periodically.

16. Data Processing & Requests

For any data-related inquiries, including requests for data access, correction, deletion, portability, or any questions regarding how your personal data is processed, please contact our Data Protection Officer at [email protected].
We will respond to all data-related requests within 30 days. We may require identity verification before processing your request.

17. Entire Agreement

These Terms of Service constitute the entire agreement between you and Orihost regarding your use of our services and supersede all prior agreements, representations, and understandings.
